Immigration advocates and legislators across the state of California have taken quick steps to address and hopefully minimize the impact of many of Trump’s new actions on immigration. Whether resorting to legal action challenging Trump policies or working to resolve other immigration problems that Trump has not yet addressed, California politicians and activists will pose a strong opposition to many immigration policies and orders issued by the Trump administration. Some government leaders have voiced their intentions of suing the Trump administration over its intention to withhold federal funding from cities and communities with sanctuary policies. California Attorney General Xavier Becerra quickly pointed out that Trump’s executive orders cannot violate or replace existing laws, and that the California Department of Justice will protect all of its residents from unwanted or illegal intrusions, including the federal government. U.S. Senator Dianne Feinstein raised concerns about the administration’s failure to address the fate of the Deferred Action for Childhood Arrivals (DACA) program, as well as the administration’s request to Congress to divert billions of dollars to build a border wall. The California Senate has introduced a number of bills designed to thwart the Trump administration’s policies on immigration. One such bill prevents the usage of state and local tax dollars and law enforcement resources for efforts to assist Immigrations and Customs Enforcement (ICE). Likewise, the Due Process for All Act is designed to ensure that all immigrants facing removal have due process protections and adequate legal representation. Other government officials expressed dismay at the negative impact on the economy that mass deportations would have. They also indicated that the withholding of federal funding from those communities with sanctuary policies would make their cities and counties less safe due to an inability to adequately fund law enforcement efforts. Concerns about the due process rights of immigrants facing removal are paramount. While the California legislature is working to protect its immigrant residents, the reality is that many immigrants are already facing deportation and many more will be facing deportation in the near future.
