In the American justice system, even those who are accused of the most horrendous crimes are entitled to court-appointed lawyers. Nonetheless, children who are accused of violating immigration laws appear in federal immigration court every day across the United States, often without a lawyer. This occurs despite the fact that the federal government is represented by a lawyer. Unlike alleged criminals, children and adults appearing in immigration court have no right to a court-appointed attorney. Even worse, there is no other legal system in the United States in which children are required to represent themselves against a government lawyer. Statistics show that having an attorney can make all the difference for a child who has illegally entered the United States. In a recent New York Times article, federal data collected by the Transactional Records Access Clearinghouse of the Syracuse University shows that between October 2004 and June 2016, more than half of the children who represented themselves in court without lawyers were deported by the immigration court. On the other hand, only one of 10 children with attorneys were deported during that same timeframe. In response, the ACLU and other civil rights organizations such as Public Counsel and the Northwest Immigrant Rights Project, have filed a class action lawsuit, hoping to establish a right to counsel for children in immigration proceedings. The groups represent nine Central American children between the ages of 10 and 17 who are currently proceeding without attorneys in immigration court. The case is currently pending in the United States Court of Appeals for the Ninth Circuit.
