The Office of the Inspector General (OIG) conducted an unannounced inspection of the Theo Lacy Facility (TLF) in Orange County, California, last November. The Orange County Sheriff’s Department (OCSD) operates TLF, which can house up to 3,442 male detainees. At last count, the detention facility held 528 immigrants. In a report released in early March, the OIG detailed the findings from the inspection, which included numerous health risks and safety concerns. The inspectors found a number of health violations in the facility’s kitchen, including refrigeration units containing slimy, foul-smelling, and obviously spoiled lunch meat. In other areas of the facility, inspectors found shower stalls containing mold and mildew, cells full of trash, and inoperable phones. The facility also has failed to comply with the Immigration and Customs Enforcement (ICE) detainee classification process, which separates detainees based on past criminal offenses, immigration violations, and other security risk factors. Rather than appropriately separating the detainees, the facility allowed low-risk detainees to mingle freely with high-risk detainees. Finally, the facility was not adequately tracking detainee grievances in order to ensure proper follow-up action occurred. The OIG recommended in its report that ICE take steps to ensure that TLF is complying with U.S. Department of Agriculture safe food handling guidelines. The second recommendation was for ICE to undertake a full review and inspection of TLF and the Orange County Sheriff’s Department’s management of TLF. The OIG also recommended that ICE develop a comprehensive oversight plan to ensure compliance.
