After several federal judges across the country granted stays of Trump’s first travel ban, the U.S. Department of Justice announced its intent to appeal the rulings. Trump claimed that the government’s appeals would succeed for the “safety of the country” and even went so far as to personally disparage one “so-called” federal judge via Twitter, characterizing his decision as ridiculous. Trump continued his criticisms for the next few days, stating, “The judge opens up our country to potential terrorists and others that do not have our best interests at heart.” In addition to granting temporary stays of the travel ban, the Ninth Circuit Court of Appeals also lifted the temporary ban on all refugee admissions, questioning the constitutionality of Trump’s order. Unlike past presidents, Trump may have made the government’s position more difficult by directly commenting on pending litigation. More specifically, when Trump disrespects judges and their decisions through his Twitter comments, it becomes harder for him to insist that the federal courts respect his authority as president. Under the U.S. constitution, the judiciary is meant to be a check on the powers of Congress and the president. Once the courts temporarily lifted the travel ban, immigration advocacy groups, including the American Civil Liberties Union and the International Refugee Assistance Project, urged immigrants from the seven countries named in the ban to travel immediately due to the possibility of the courts deciding to reinstate the travel ban or place it on hold. Similarly, the U.S. State Department intended to immediately start admitting refugees to the country as a result of the Ninth Circuit’s more expansive ruling.
