American immigration courts reportedly are making the switch to focus more on removal hearings for immigrants whom Immigrations and Custom Enforcement (ICE) have detained. The Chief Immigration Judge announced this change in policy, which moves away from the department’s previously stated priority on unaccompanied children and families arriving at the U.S.-Mexican border. The past administration had focused on children and families in this area of the country in order to deter continued border crossings and assist those immigrants with strong cases for asylum or other forms of relief from removal. What remains unclear, however, is whether this policy shift will result in the cases of detainees moving more quickly through the removal process. At the same time, the Trump administration is promising to increase enforcement of immigration laws and detain more immigrants who are present in the U.S. with no legal status, as well as those caught attempting to cross the border. If he makes good on this promise, the immigration court system that is already overburdened with over 533,000 pending cases threatens to overflow. In a court system where judges’ decisions are often years in the future, it is unclear how an increase in ICE detentions will affect the progression of cases. One sure result of increased detentions is the need for the government to find more jail beds. If ICE picks up individuals who are jailed for crimes, they will need more space to lodge these individuals. At present, the Department of Homeland Security only has the ability to house up to 34,000 detainees at the same time. Moving the removal cases of detainees more quickly through the immigration court process, however, could free up more beds at any given time.
