How Does an Employment-Based Green Card Work?

If you are an employee, or a U.S. based company wants to hire you, your employer can sponsor you to obtain permanent residency. If you receive a job offer from a U.S. based employer you can ask whether the company will sponsor you for a Green Card.

What Types of Visas Are Available?

There are two types of visas available in the United States — nonimmigrant and immigrant visas.

  • Nonimmigrant visas are intended for short trips to the U.S. for reasons as tourism, business,
    medical treatment, or temporary work.
  • Immigrant visas are foreign nationals who intend to live and work permanently in the United
    States. These are typically obtained through sponsorship from a relative
    or employer. Those applying who are investors, special immigrants, or
    workers with extraordinary abilities may petition themselves.

    • Second Preference EB-2 visa: professions holding advanced degrees in arts,
      sciences, or business
    • Third Preference EB-3 visa: professionals, skilled workers, and other workers
    • Fourth Preference EB-4 visa: “special immigrants” — religious
      workers, employees of U.S. foreign service, SIJ, etc.
    • Fifth Preference EB-5 visa: business investors who have invested $1.8 million
      or $900k in new commercial enterprise that employs 10 full-time U.S. workers
