Deferred action for childhood arrivals is a Department of Homeland Security (DHS) program that recognizes the federal government’s need to focus on national security and public safety, rather than on low priorities such as individuals who simply came to the U.S. illegally as children. It can be a defense to removal if you are eligible for the program. In order to qualify for consideration of deferred action for childhood arrivals, you must meet the following conditions:

  • You are under the age of 31 as of June 15, 2012
  • You entered the U.S. prior to turning age 16
  • You have continuously resided in the U.S. since June 15, 2007
  • You were physically present in the U.S. on June 15, 2012
  • You entered the U.S. without inspection or your lawful immigration status expired prior to June 15, 2012
  • You are in school, have graduated from or completed high school or obtained your GED, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States
  • You are not a threat to national security or public safety
  • You have not been convicted of a felony, significant misdemeanor, or three or more misdemeanors

If you meet all of the above requirements, you can request consideration of deferred action for childhood arrivals for two years, subject to renewal.
