Instead, it must be submitted on paper alongside Form I-485.To start, download Form I-130 and its instructions from the USCIS website. It's advisable to also download the instructions to address any confusion that may arise while completing the form.
For individuals working with an attorney, ensure to check Box G-28 and provide the attorney's details, including their bar number.
A signed Form G-28 authorizing the attorney to represent you is necessary.
Next, in Part 1 of the form, select the appropriate category based on your relationship with the beneficiary. For marriage-based cases, indicate that you're filing the petition for your spouse.
Part 2 requires information about the petitioner, including their Alien Registration Number (A-number) if applicable, full name, date of birth, and address history for the last five years.
In Part 3, details about the beneficiary (spouse) are provided, such as their full name, date of birth, country of birth, and address history.
Part 4 focuses on biographic information about both the petitioner and the beneficiary.
Part 5 involves providing information about previous petitions filed for the beneficiary and any other aliens. After completing the relevant sections, sign and date the form. If working with an attorney, they willalso sign and provide their details.Form I-130A is filled out by the beneficiary (spouse) and includes personal information such as address history, employment history, and details about parents.
