Oakland Humanitarian Asylum Lawyers

Over 600 Immigration Cases Successfully Handled

Are you or a loved one in urgent need of entering the United States for a limited amount of time but unable to go through the traditional channels for asylum? Humanitarian asylum might be a solution. United States immigration law has provisions for those who are unable to receive a visa for entry into the country for humanitarian reasons or for public benefit.

Humanitarian asylum can be granted when:

  • The applicant has been a victim of severe persecution in the past; or
  • The applicant has a reasonable belief of sustaining serious harm upon return to their country.

All humanitarian asylum claims are granted on a case-by-case basis. Working with a knowledgeable humanitarian asylum attorney at Landerholm Immigration, A.P.C can provide guidance through this complex process.

Am I Eligible For Humanitarian Asylum?

To be eligible for humanitarian asylum, you must be seeking protection from severe past persecution. This means that significant and lasting harm was inflicted upon an individual. Examples include torture and hard labor, or ongoing medical effects from female genital mutilation. Unlike other asylum claims, humanitarian asylum is not dependent on governmental persecution relating to race, religion, nationality, political opinions, or membership in a particular social group. Other serious harm can relate to civil war, extreme economic hardship, or severity of harm equal to persecution. An immigration judge determines whether to grant humanitarian asylum based on the above factors, and working with an immigration lawyer can help provide the evidence to prove these claims.
